Travis County, TX — July 1, 2024, a Marble Falls woman and two children were injured following an alleged drunk driver accident at around 3:21 a.m. on TX-71.

According to current statements from officials, the accident took place several miles west of Bee Cave near the intersection of Highway 71 and Cypress Ranch Boulevard.

Investigators said that a 31-year-old Marble Falls woman and two children, ages 2 and 9, were in a Volkswagen Tiguan going southbound on the highway. From the northbound lane, a Kia Cadenza crossed over the center turn lane and crashed into the Volkswagen. As a result, the woman and the two children were seriously injured.

Authorities allege that the Kia driver was under the influence of alcohol at the time, and they recommended charges for intoxication assault. If that’s true, it’s important to keep in mind that doesn’t make a situation like this open-and-shut. In fact, it can lead to even more complex legal mazes depending on what led to the accident. Specifically, if the drunk driver was illegally over-served by an alcohol provider, they may be responsible for this, as well.

For example, I handled a case a while back where a drunk driver went into oncoming traffic, hit a family’s car, and nearly killed a young boy. Through our investigations, we found that the man had been illegally over-served by a bar. Despite the fact he got to the point he could barely walk to the bathroom without nearly falling over, servers continued pouring drink after drink. That exposed them to potential criminal investigations, fines, license suspensions, and liability for the near fatal accident they contributing to.

The problem, though, was authorities never bothered investigating that bar. The family had no idea that was something important to look into, but once they saw the evidence we brought to light, they were shocked authorities never took their own steps to see that negligent bar face consequences. Unfortunately, across hundreds of similar cases against negligent alcohol providers, I’ve seen far too many situations where authorities began and ended their investigations at the crash scene. Many of the establishments our firm has put on the straight-and-narrow likely would have avoided consequences entirely had our clients simply trusted authorities to handle everything on their own.

So while I can’t say what all happened here, the simple fact there’s an alleged drunk driver is cause for concern. If authorities here are motivated to see full accountability for the mistakes that led to this crash, they should be looking into the possibility the alleged drunk driver had an accomplice to all of this. Either they can rule that out, or they can work to ensure there are appropriate consequences for all of the wrongs that harmed the victims.
