Commentary by Attorney Michael Grossman

Some folks may jump to conclusions about who’s to blame here, since a lot of people still believe the old myth that someone is automatically responsible for rear-ending someone. That’s just not true.

For example, I recall an accident not long ago where people were killed after rear-ending an 18-wheeler on a dark highway. It took weeks before authorities revealed the 18-wheeler had merged off the shoulder without its lights on. Would anyone in their right mind blame the rear vehicle for that? Of course not.

Of course, there are all kinds of things that could have contributed to this accident. Lighting, speeding, fatigue, alcohol, road hazards, mechanical defects, etc. Likely or not, the point is that this is no time for rushing to conclusions. Someone lost their life, and others nearly were killed, as well. That demands clear answers about how all of this could have been avoided.
