Fort Worth, TX — February 5, 2025, Machello Desouza was injured due to an alleged drunk driver accident at around 11:05 p.m. along Interstate 35W.

Officials said in preliminary statements that the accident happened at the intersection of the I-35W service road and Basswood Boulevard.

According to investigators, 25-year-old Machello Amiri Desouza was in a Lexus going northbound along the service road. While doing so, a Hyundai Santa Fe going eastbound reportedly disregarded the light, crashing into Desouza.

As a result of the collision, Desouza was seriously injured. The other driver apparently had no injuries. Authorities allege that driver was under the influence of alcohol at the time, and they recommended a charge for intoxication assault.

Authorities recommending charges here doesn’t necessarily make the situation open-and-shut. It’s important for there to be investigations beyond the surface following a crash like this. Drunk drivers obviously deserve to be held accountable, but there may be an accomplice: a negligent alcohol provider.

Simply put, alcohol providers who over-serve patrons that are obviously intoxicated can face consequences. This can include potential criminal investigations, fines, suspended licenses, or liability for injuries resulting from the intoxication. Not only can these avenues act as a means of punishment, they can get negligent alcohol providers to clean up their act before more people get hurt.

That’s why it can be so frustrating when authorities don’t take steps to investigate negligent alcohol providers. I’ve handled hundreds of cases against bars and other establishment for their role in serious accidents. More times than I can count, our investigations uncovered a negligent alcohol provider that was never even blip on the police’s radar.

This is one of the reasons I talk about accidents like this one. If authorities suspect alcohol was a factor, those involved in the accident need to know they’re getting the whole story. Not only is it in their best interest to know the whole story, but it’s also in the best interest of our whole DFW community to know if there are local establishments putting lives at risk.
