Commentary by Attorney Michael Grossman
Crashes involving parked semi-trucks raise important legal questions, particularly about whether the truck was stopped safely and whether the other driver had an opportunity to avoid the collision. While reports indicate the Buick crossed into oncoming traffic before hitting the truck, that doesn’t automatically mean this was an unavoidable crash. The real question is whether all reasonable steps were taken to prevent it.
One key issue investigators should look at is why the truck was parked on the shoulder. In general, the shoulder is meant for emergencies, not routine stops. Was the truck experiencing mechanical issues, or was the driver stopping for another reason? If the truck was parked unnecessarily, that could be a contributing factor. Even when stopping is justified, drivers are required to follow safety procedures, such as activating hazard lights and using reflective warning devices to alert approaching traffic. Investigators should determine whether those precautions were taken.
Another question is why the Buick veered out of its lane. Did a road hazard, such as debris or another vehicle’s actions, force them to swerve? Reviewing roadway conditions, vehicle data and any available dashcam footage could help provide answers.
It’s easy to assume that because the truck was parked, it had no role in the crash. But in my experience, that’s not always the case. If the investigation stops at surface-level details, key factors may be overlooked. A thorough review of all the circumstances is necessary to determine who should be held accountable and whether anything could have been done to prevent this wreck.
