Commentary by Attorney Michael Grossman

One of my main concerns with motorcycle wrecks is that they don’t always get the attention they deserve. Unfortunately, a lot of people are biased against motorcyclists, and this can lead to shallow or shoddy investigations. That’s why it’s sometimes important to keep a few key questions in mind to see how authorities respond.

First, did authorities have the time and tools to properly document the scene? Motorcycle crashes are particularly sensitive to small details like skid marks, debris patterns, or road surface conditions. If officers are under pressure or lack the proper resources, there’s a risk those details won’t be fully captured.

Second, has anyone looked into whether a vehicle defect played a role? Motorcycles, like other vehicles, can suffer from failures in critical systems—steering, brakes, or even tire blowouts. And when crashes happen, safety gear like helmets or protective clothing might not function properly. A close inspection of the bike and gear is essential, but that rarely happens unless someone pushes for it.

Finally, has all available electronic data been collected? While motorcycles don’t always have onboard data recorders, nearby traffic cameras or security cameras at residences or businesses may have captured footage. Cell phones can also reveal GPS data which may shed light on the moments leading up to the crash. It’s important that such information is preserved promptly.

Asking these questions early on can make all the difference. Either they can show that authorities are being thorough in their efforts, or they’ll show there are shortcomings independent investigators need to look into.
