Mount Pleasant, TX — July 3, 2024, Luis Ramirez was injured as the result of an alleged drunk driver accident at around 10:15 p.m. along West Pecan Street.

Authorities said that the accident happened off of Martin Luther King Avenue at the intersection of Pecan Street and Searcy Avenue.

According to officials, 24-year-old Luis Miguel Ramirez was in a Nissan Altima going eastbound on Pecan Street. A westbound Chevy Silverado then crossed left of center, crashing head-on into Ramirez’s vehicle. As a result, Ramirez sustained serious injuries. The other driver was allegedly under the influence of alcohol at the time, and authorities recommended a charge for intoxication assault.

With accidents like this, one thing I try to remind people about is things aren’t necessarily open-and-shut once authorities file charges against the alleged drunk driver. There also needs to be consideration for the possibility a local alcohol provider illegally over-served that driver. In Texas, if a bar or some similar establishment serves someone who is obviously intoxicated, they can be subject to criminal investigations, fines, license suspensions, and even liability if that contributes to someone being hurt or killed.

The problem is that this area of the law doesn’t really get enough attention. I’ve handled hundreds of cases against negligent alcohol providers for their role in getting people hurt or killed. Far too often, we’re the only ones looking for those alcohol providers. Despite the establishments breaking the law and being legally responsible for harming someone, authorities simply move on to other responsibilities once they have a drunk driver facing charges. It’s frustrating to think how many of those establishments would have simply been let off the hook had we not been looking for them. More than that, it’s troubling to think of how many people affected by negligent alcohol providers never see full accountability for the harm done to them because they trust that authorities were going to take their accident seriously. Hopefully authorities here are being more thorough, but that’s frankly not something I’d take for granted.
