Bastrop County, TX — September 11, 2024, 30-year-old Luis Martinez Chaverria was killed and three people were injured in an auto accident on State Highway 21 in Bastrop County.

Authorities say the incident happened around 6:05 a.m. on SH 21 near Farm to Market Road 535. Preliminary investigation suggests a Toyota Highlander was traveling east on the highway near FM 535, while a westbound GMC C1500 pickup approached from the other way. Behind the GMC at some distance, Martinez Chaverria was driving a Honda Accord west.

According to reports, the 13-year-old driver of the Toyota drifted left out of his lane for unknown reasons. The SUV passed through the center stripe divider and sideswiped the westbound GMC pickup. The Toyota then continued east in the westbound lanes, allegedly at high speeds, until it crashed head-on with the Honda.

Luis Martinez Chaverria was fatally injured in the crash. The Toyota’s teen driver suffered serious injuries; his 16-year-old passenger and the driver of the GMC pickup received non-life-threatening injuries.

I admit, like most people I was taken aback when I saw that the vehicle which allegedly lost control was driven by a 13-year-old. It does no good to speculate on how or why he was at the wheel, but I suspect many people saw his age and decided that was enough information to place fault on his young shoulders. Even investigators seemed to lean that direction, and I understand the temptation. However, as always I must caution against jumping to any conclusions without all the facts.

Am I saying the eastbound vehicle didn’t cross left of center? Of course not. Do I think factors out of that young driver’s control could have influenced events? I think it’s worth looking into. Did anyone look into whether the pickup was in good repair? Was it defective or malfunctioning in any way? What condition were its tires in? Was the young driver in good health? Reports describe conditions as dark and cloudy; were the road’s painted lines hard to see? Were there reflectors for low-light driving? Did the safety features in the victim’s car (seat belts, air bags, brakes) all work properly after the impact?

To be clear, I don’t know anything more than preliminary reports tell. None of the above questions are meant to undermine the conclusions there; I just know from long experience that things aren’t always what they seem, and sometimes nobody realizes what they missed. Everyone affected by this accident deserves to know they have the whole story; will someone make sure they get that peace of mind?
