Commentary by Attorney Michael Grossman

Any time I see a motorcycle accident in the news, I can’t help but wonder if it will get the careful attention it deserves from investigators. Little as I like saying it, many people harbor negative biases toward motorcyclists—biases which cause them to jump to conclusions or blame the rider for nothing more than his choice of vehicle. In reality, there are many possibilities that have to be thoroughly investigated before anyone can say with more certainty what happened. For example, here are some of the many questions that still need answers: Did either vehicle malfunction in some way? Did their brakes work? How about their headlights? Were there any issues with the road in that area? Did someone have a medical emergency? What else might have contributed to the accident, and will authorities think to check for it?

I’m not saying things necessarily have to be complicated here; most times, the simplest explanation is the right one. However, I’ve done this long enough to know that important details often go overlooked, and sometimes even investigators fall prey to certain notions about motorcycles and the supposed “daredevils” who ride them. If they let that get in the way of their work, crucial evidence might slip through the cracks. I hope they won’t let that happen, and that they can find answers for any questions the victim’s loved ones might have.
