Commentary by Attorney Michael Grossman

One of the challenges with a commercial truck wreck like this is that they’re not all that common for a rural police department to handle. An officer may only see one or two serious truck wrecks throughout their whole career. Well, that can present significant hurdles when they suddenly find themselves tasked with getting answers about what caused a truck to run off-road. The answer is rarely obvious, and ruling out complex possible factors requires training and equipment that I rarely see outside of professional independent accident reconstructions.

Was the truck in a state of disrepair? Did a tire blow out? Was the victim pressured by a negligent employer to take unnecessary risks? Did a third-party business improperly load cargo? Were there issues with the road itself? Were there other drivers involved who then left the scene? Is there video evidence yet to be pulled, either from the truck or from nearby homes or businesses? Does the truck have any known defects, or have investigators considered defects that have yet to be discovered?

Ultimately, authorities handling the crash may be able to answer these kinds of questions. But in my experience having handled hundreds of commercial vehicle accident cases, they rarely do. There usually needs to be more thorough efforts from independent investigators who have the time, tools, and training for something as complex as a commercial truck wreck. Their efforts may simply confirm that authorities were thorough in their own efforts, but that’s better than risking a family being left with unanswered questions or doubts.
