Commentary by Attorney Michael Grossman
No matter how obvious details may seem, every serious accident should be treated with care. It’s important investigations are as thorough as possible to ensure nothing important or unusual slips through the cracks. Unfortunately, authorities can’t always guarantee this, so it’s often important for people to ask some key questions.
Did investigators take the time to fully examine the crash? Determining fault in a failure-to-yield collision requires careful analysis of road conditions, traffic signals, and driver actions. Were skid marks, vehicle positions, and possible obstructions to visibility documented?
Did they check for potential vehicle defects? Mechanical failures—such as faulty brakes or acceleration issues—can contribute to a crash. Additionally, if safety features like airbags or seatbelts didn’t work properly, injuries may have been worse than they should have been. Were the vehicles inspected before key evidence was lost?
Did they preserve all electronic evidence? The vehicles’ Engine Control Modules (ECMs) may have recorded speed, braking, and steering inputs before the crash. Traffic cameras, GPS data, or cellphone records could also provide key insights. Were investigators careful to secure this information?
If authorities can’t provide satisfactory answers, then they may have been lacks in their efforts to investigate the accident. That may require a second set of eyes looking things over to ensure nothing important slipped through the cracks.
