Commentary by Attorney Michael Grossman

Something to keep in mind in these situations is that single-vehicle wrecks don’t always get proper attention from authorities. They’re not often seen as a high priority, and that can lead authorities to move on prematurely, and crucial details which might require a lot more time and effort may slip through the cracks.

For example, I had a case a while back involving a serious accident where authorities were rather hasty in their investigations. One particular factor that concerned the victim’s loved ones was a claim the victim didn’t have their seatbelt on. They knew the victim always wore their seatbelt, so it didn’t sit right. Well, sure enough, a more thorough independent investigation revealed the victim’s seatbelt had a defect. Had it not been for that defect, the injuries the victim suffered likely wouldn’t have been so serious.

I’m not suggesting that happened here, but it’s a common problem with relying solely on authorities to conduct accident reconstructions. Some departments give officers the tools and the time they need to ensure victims and families have all the facts. Other departments don’t, and people end up with unanswered questions. In my experience, when people feel they’re not getting the whole story, a second set of eyes can be a step toward giving them the peace of mind they deserve.
