Commentary by Attorney Michael Grossman
If alcohol was indeed a factor here, it wouldn’t be out of the ordinary for authorities to charge the allegedly drunk driver and move on. When they move on, though, that’s often a problem. A lot of the time, there’s an accomplice who needs to be held responsible, as well: a negligent alcohol provider. Is that being investigated here?
Simply put, alcohol providers in Texas (bars, restaurants, liquor stores, and the like) are breaking the law when they over-serve someone who is obviously intoxicated. When an establishment does so, it exposes itself to potential consequences, especially if it leads to injuries. As such, victims and families can see those negligent alcohol providers held accountable for their role in an accident just as drunk drivers are held accountable for theirs.
Too often, though, authorities completely overlook this. I’ve handled hundreds of cases against negligent alcohol providers. I can’t count how often a family came to me after a drunk driving accident, we looked into where the driver had been drinking, and we found authorities had already moved on to other investigations.
At the end of the day, victims and families deserve to know all parties who wronged them are going to face appropriate consequences. That’s especially true if doing so can help prevent others from getting hurt in the future.
