Commentary by Attorney Michael Grossman
There are certainly more questions than answers here, but here’s one that immediately comes to my mind. This happened at night on a two lane road city road—not some highway or traffic-controlled intersection with a median. What I want to know is, why would a truck driver ever attempt a u-turn here, and why did this specific driver think that they were able to do so without risking an accident?
Were there extenuating circumstances they couldn’t avoid? Was the driver just being impatient and reckless? In my experience handling hundreds of commercial vehicle accident cases, I can’t recall a time a truck driver made a decision like this without being incredibly negligent. I wonder what evidence authorities found here or whether there might be something they overlooked.
