Commentary by Attorney Michael Grossman

People may see allegations of a truck driver running a stop sign and assume everything is open-and-shut. After all, that’s an obviously wrong thing to do. However, it’s important that investigations are able to explain why the truck driver disregarded the stop sign. There could be more serious underlying issues that led to this situation than just a single reckless driver.

Having handled hundreds of commercial vehicle accident cases, I’ve dealt with many companies that foster negligent behavior or create a working environment that makes mistakes all but inevitable. For example, many companies push drivers to meet unreasonable deadlines. This can lead to drivers speeding, rolling through stop signs, driving while distracted, or driving over hours of service limits. Additionally, there are also companies that allow unqualified drivers behind the wheel. These could be inexperienced drivers who are rushed through the training process, or they could be drivers with a history of reckless driving the employers failed to weed out during the hiring process—either through laziness or incompetence.

At the end of the day, investigations could show that this all was the result of a single reckless individual. Or, they could show that a series of bad decisions culminated in a serious truck accident. Either way, it’s important that investigations are able to confirm or rule out these possible factors. Those affected by a commercial truck wreck deserve to know that all of the wrongs that led to the crash are going to be fully addressed. It remains to be seen of authorities are taking those necessary steps here.
