Willacy County, TX — July 6, 2024, Kyleigh Hernandez was killed following an alleged drunk driver accident at around midnight on F.M. 1762.

Investigators said in preliminary statements that the accident happened at the intersection of Farm-to-Market 1762 and Cantu Road, just northeast of Raymondville.

According to current statements, 25-year-old Kyleigh Hernandez was in a Nissan Maxima going westbound along F.M. 1762. At Cantu, a northbound Dodge Ram reportedly ran the stop sign and crashed into Hernandez. As a result, Hernandez sustained fatal injuries. The other driver is said to be facing a charge for intoxication manslaughter.

Something that stands out to me in reports on crashes like this is how there’s often a reminder from the authorities about the dangers of drunk driving. Obviously, I agree with the sentiment. Yet authorities often overlook another significant reason deadly crashes like this happen: alcohol providers breaking the law and over-serving people. Could it be something like that happened here?

Simply put, I’ve handled hundreds of cases against negligent alcohol providers who played a role in a serious accident. Too often, my team and I are the only ones looking into those establishments. Authorities typically go to great lengths to hold the drunk drivers accountable—rightfully so. But then, their investigations just stop there unless a family demands they continue or an independent investigation team brings them evidence on a silver platter.

At the end of the day, if people want to know how to make our roads safer, punishing drunk drivers (as appropriate as those consequences are) may only scratch the surface. Finding out where a drunk driver got their alcohol could show there are other wrongdoers who need to be held accountable, and it could also get them to clean up their act before they harm anyone else. It would be encouraging to hear authorities handling this accident were more thorough than usual and have been able to dig into these details. But if there was still more to this story yet to be ruled out, it wouldn’t be the first time.
