Commentary by Attorney Michael Grossman

When accidents like this happen, it’s easy for people to assume they stem from a momentary error or simple bad timing. However, based on my experience, crashes involving large trucks often require a thorough investigation to uncover all the factors at play. This incident on Interstate Highway 70 is no exception.

Investigators will need to determine why the Freightliner veered out of its lane, leading to the truck’s overturn in the median. Key issues to explore include whether the driver was distracted, fatigued, or if mechanical issues, such as brake or steering failures, contributed to the loss of control. Large trucks require precise handling and substantial stopping distances, and even minor lapses in attention or equipment can have serious consequences. Mechanical issues, in particular, can play a significant role if the truck’s components were not properly maintained or inspected.

If the truck was operating under a commercial company, investigators should examine whether the company met its safety obligations. This includes ensuring that the vehicle received regular maintenance and that the driver was adequately trained and following hours-of-service rules to avoid fatigue. Companies are responsible for upholding high safety standards, and any lapse in these areas could suggest shared responsibility for the wreck.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to gather vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
