Commentary by Attorney Michael Grossman
When crashes like this occur, people often assume they result from simple mistakes or momentary lapses in judgment. However, in my experience, head-on collisions involving passenger vehicles and 18-wheelers usually involve a combination of factors that need thorough investigation to uncover.
What caused these two vehicles to collide? Did one of them cross the center line, and if so, why? Was there an attempt to avoid another obstacle, a medical emergency, or a distraction that led to the collision? Could mechanical failures like steering or brake malfunctions have played a role? Answering these questions is critical to understanding how this deadly crash occurred and whether it could have been prevented.
The involvement of a commercial truck raises additional concerns. Was the Freightliner properly maintained to ensure its safety, or did equipment failure contribute to the collision? Was its driver following federal hours-of-service regulations designed to prevent fatigue? Trucking companies have a duty to ensure their vehicles are roadworthy and their drivers are well-trained and capable of handling emergencies. If the company fell short in these areas, it could share responsibility for the outcome.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
