Commentary by Attorney Michael Grossman

When people see preliminary reports blaming a driver for a crash, the first thought is that everything is open-and-shut. The reality, though, is that people need evidence to make sure the full story is told fairly.

At the end of the day, drivers potentially facing charges and people getting the help they need after a crash are two separate areas of the law. A preliminary crash, report—clear or not—isn’t likely to be enough on its own to get victims and families a proper resolution.

That’s why a lot of families end up having independent investigators look things over and put together a stronger story than what police generally do on their own. That way, they can help ensure there’s a better outcome for the people hurt in the crash.
