Commentary by Attorney Michael Grossman
Obviously, there should be continued efforts to find the person who left the accident scene, especially since there’s likely something they didn’t want authorities to find out about (like drunk driving) that led them to flee. But there’s something that stood out to me here which may not have received the attention it deserved. What I’m wondering is why only one person was seriously hurt here. Let me explain why that stands out to me.
Simply put, most accidents will see people in the same vehicle sustain at least somewhat comparable injuries. Someone may be in better or worse condition than someone else, but to have one person seriously injured while everyone else is apparently fine raises a red flag. Were there particular circumstances about the crash that explains this, or could this be a sign the victim was harmed by a vehicle defect? Did their seatbelt function properly? Was there an airbag that didn’t go off? Did they experience seatback failure? Were there other issues authorities may have overlooked?
It isn’t like this is a likely factor, but that’s why it’s important to consider whenever these red flags come out. Since defects aren’t common, authorities rarely have the experience or equipment to investigate them. People may not even know something unusual happened unless more thorough independent accident reconstructionists point it out. Those efforts might show nothing out of the ordinary happened here, but it’s often best to err on the side of caution when it comes to ruling out something as serious as a vehicle defect.
In the meantime, if anyone in the public thinks they have information that could help identify the runaway driver, they’d be wise to come forward as soon as possible.
