Commentary by Attorney Michael Grossman
When fatal crashes like this occur, it’s natural to wonder about the immediate causes. However, based on my decades of experience with commercial vehicle accident cases, the full story often lies beneath the surface. Crashes involving solid waste trucks, like the one described here, require careful examination of multiple factors to understand what truly went wrong.
One of the most pressing questions is why the truck veered off the road in the first place. Was there a mechanical issue, such as brake failure or a steering malfunction, that made it impossible to maintain control? Did the driver face an unexpected hazard or distraction? Was there an underlying issue, such as fatigue or inadequate training, that impacted their ability to safely operate the vehicle? These possibilities demand thorough exploration.
Another critical element is the maintenance of the truck itself. Solid waste trucks are subject to significant wear and tear due to the nature of their operations. Was this vehicle properly inspected and maintained, and were all safety systems, such as brakes and stability controls, functioning as they should? Faulty equipment can turn manageable situations into life-threatening disasters, and understanding the truck’s condition is key to determining whether it contributed to this crash.
The role of the waste management company also warrants scrutiny. Companies that operate commercial vehicles have a responsibility to ensure their fleet is roadworthy and that drivers are adequately trained and supported. Did the company uphold its obligations in this case? Were there any systemic issues, such as insufficient safety protocols or pressure to meet demanding schedules, that might have played a role?
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
