Commentary by Attorney Michael Grossman
When a truck driver is cited for failure to yield in a crash like this, it’s usually a sign that someone didn’t follow the most basic rule of the road: don’t enter another vehicle’s path unless it’s clearly safe to do so. That may sound like a simple mistake, but legally, it’s a serious breach of duty.
Drivers of commercial trucks have an even greater responsibility because of the size and weight of their vehicles. A misjudgment in timing or distance can have life-altering consequences for anyone in a smaller vehicle. That’s why turning across or into traffic is one of the most high-risk maneuvers a truck driver can make, and why failure to yield is one of the most common causes of serious commercial vehicle accidents.
Now, what this citation tells me is that the truck driver likely turned onto U.S. 59 when it wasn’t safe to do so, cutting off the approaching Nissan. But what it doesn’t tell me is why that happened. Was the driver distracted? Was visibility poor at the time? Did something about the truck’s condition — like its lights, brakes or mirrors — play a role? And just as important, was the driver properly trained and following the company’s safety policies?
In my experience, the real story behind these crashes is rarely limited to what’s found at the scene. Getting a citation is not the same as understanding the full extent of what went wrong. That takes a more thorough investigation that looks into driver training, company procedures and vehicle maintenance. If those pieces are missing, then the real cause of the crash could be missed.
