While no further information is clear right now, some people likely made up their minds when they read that this was a rear-end collision. It’s one of the worst misconceptions I have to deal with—that rear drivers are automatically at fault in these collisions. That’s simply not true, and it would be ridiculous if it was.
For example, I remember a crash a while back where initial details simply said a man hit the back of an 18-wheeler on the highway, killing him and his child. Well, weeks later, authorities finally revealed that the 18-wheeler had actually pulled off the shoulder into the man’s path without its lights on. If the law said the victim was at fault for that just because he was in the rear, it would be outrageously unfair.
To be clear, I don’t know what happened here. Maybe something common like distraction or fatigue led to the accident. Maybe someone cut off the victim or did something they couldn’t avoid. Or maybe this was some one-in-a-million, unpredictable accident. At the end of the day, it’s best to let the evidence speak for itself.
