Commentary by Attorney Michael Grossman
One of the main issues with motorcycle wrecks is people are often quick to jump to conclusions. I’ve handled many accident cases over the years where motorcyclists fell victim to circumstances which were either mostly or entirely outside of their control. Yet every time, there was someone already blaming the victim. Even authorities can be quick to rush to judgment, especially if they see the crash as a low priority.
With a proper accident reconstruction, investigators should be able to consider all kinds of possible factor. Did a tire blow out? Was the road in poor condition? Did another driver force the bike off-road, then flee the scene? Did the motorcycle have any defects? Were there issues with signage or lighting in this area? Likely or not, these factors can happen. They’re as important to investigate for people on two wheels as they are for people on four or even eighteen.
Maybe authorities here have been thorough enough to give this accident the attention it deserves. But whenever it seems like they’re missing something or ignoring something just because it seems unlikely, it can be prudent to make sure a second set of eyes looks things over to ensure nothing important is being overlooked.
