Commentary by Attorney Michael Grossman

When I read about a hit-and-run accident like the one that left Kendor Brito seriously injured, my first thought is whether authorities will be able to identify the driver responsible. While a hit-and-run may seem like a straightforward case of someone fleeing the scene, there are still key investigative steps that must be taken to ensure all possible factors are considered. To that end, there are three critical questions that need to be asked.

First, did the authorities conduct a thorough investigation? In cases like this, where a vehicle entered the wrong lane and caused a crash before fleeing, gathering evidence quickly is crucial. Investigators will likely rely on witness statements, security camera footage from nearby homes or businesses, and any physical evidence left behind, such as vehicle debris or paint transfer on the motorcycle. However, the effectiveness of the investigation often depends on available resources. If authorities struggle to identify the vehicle or driver, independent investigators may need to step in to review the case.

Second, has anyone looked into whether a vehicle defect played a role? While it’s easy to assume that the hit-and-run driver was simply reckless, it’s still worth considering whether a mechanical failure—such as a braking or steering issue—contributed to their actions. Additionally, many modern vehicles have advanced safety features designed to prevent head-on collisions. If those systems failed to work properly, that could be an important factor in understanding how the crash happened. Unfortunately, vehicle defects are rarely investigated unless someone specifically pushes for it, and once the vehicle leaves the scene, it becomes much harder to examine.

Lastly, have investigators gathered all available electronic data? In today’s world, technology plays a crucial role in solving hit-and-run cases. Surveillance footage from nearby homes or businesses, dashcam recordings from passing vehicles, and even traffic cameras could provide valuable information about the suspect’s vehicle. Additionally, modern cars are often equipped with event data recorders (EDRs) that can reveal key details about a car’s speed, braking, and steering before a crash. If the driver is found, securing this data quickly could be essential in determining what really happened.

At the end of the day, answering these questions could be essential to understanding what really happened. Motorcycle accidents can be particularly devastating, and when a driver flees the scene, it only adds to the uncertainty for those left behind. A complete and thorough investigation is the least that can be done to ensure that those affected by the crash receive the answers they deserve.
