A critical question that often gets overlooked is where the driver had been drinking and whether an alcohol provider contributed to the situation. Let me explain.
Texas dram shop laws say that serving alcohol to someone who is obviously intoxicated is unlawful. If the GMC driver, for example, was over-served before getting behind the wheel, then the establishment that provided the alcohol may also bear responsibility for what happened here.
Too often, these crashes are treated as isolated incidents when, in reality, they often begin long before a driver gets on the road.
