Commentary by Attorney Michael Grossman
When crashes involving large commercial vehicles occur, it’s natural for people to focus on the apparent mistakes that led to the collision. However, based on my experience handling cases like these, I know that accidents involving 18-wheelers often have more complex origins. What might initially seem like a simple failure to yield could actually be the result of a combination of issues, from driver error to vehicle condition to company practices.
The most immediate question in this case is why the Volvo 18-wheeler allegedly failed to yield the right-of-way. Was the truck driver distracted or perhaps under pressure to meet a delivery deadline? Were they unfamiliar with the area or struggling to safely navigate highway conditions? Determining the driver’s role is essential to understanding what went wrong.
The role of the trucking company also needs to be examined. Commercial vehicle operators are responsible for ensuring their drivers are adequately trained and fit to operate large trucks safely. Did the driver have the proper training to anticipate and handle right-of-way situations? Additionally, was the company enforcing policies or deadlines that may have pressured the driver into risky behavior? These are critical questions that could reveal whether corporate practices contributed to the accident.
The condition of the truck itself is another significant factor. Commercial vehicles are equipped with safety measures like turn signals, brake lights, and reflective markers to alert other drivers of their actions. Were all these systems functioning correctly at the time of the crash? Any failure in these mechanisms could have played a role in the collision.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure Katlyn Robinson and her family receive the clarity and closure they deserve.
