Commentary by Attorney Michael Grossman
When a single-vehicle accident results in the loss of life, a thorough investigation is essential to determine how and why it occurred. In my experience, understanding incidents like this requires careful attention to three critical questions.
First, did the authorities thoroughly investigate the crash? Single-vehicle rollover accidents can stem from a variety of factors, including external influences or mechanical issues. Investigators should closely examine the crash site for evidence such as tire marks, debris, and the vehicle’s final position. Witness accounts and any available surveillance or traffic camera footage could also provide valuable context, particularly about whether speed, distractions, or road conditions played a role.
Second, has anyone considered whether a vehicle defect might have contributed to the crash? Rollover accidents often raise questions about mechanical factors, such as tire blowouts, brake failures, or suspension issues, which can make it difficult to maintain control. A detailed inspection of the Buick Encore is essential to identify or rule out any such defects. Additionally, the functionality of the vehicle’s safety systems, including seat belts and airbags, should be reviewed to assess whether they operated as intended to protect Karon Fishbeck during the accident.
Finally, has all relevant electronic data been collected? Most modern vehicles, including the Buick Encore, are equipped with event data recorders (EDRs) that capture critical details such as speed, braking, and steering inputs leading up to the crash. This data can provide key insights into whether the vehicle’s behavior was consistent with driver input or indicative of mechanical failure. Securing this information promptly is vital to preserving evidence that may otherwise be lost.
Accidents involving severe outcomes, such as fatalities, demand comprehensive investigations to uncover all contributing factors. By addressing these questions, investigators can work toward providing a clearer understanding of what happened and why. A thorough investigation is the least that can be done to ensure every possible factor is carefully examined. For the loved ones of Karon Fishbeck, obtaining these answers is an essential step toward clarity and closure.
