Commentary by Attorney Michael Grossman

Included in statements was a toxicology test result reportedly showing that the driver was over two and a half times the legal limit for drunk driving. Just to be clear, I don’t bring this up to speak ill of the victim. On the contrary, I’ve seen those levels of alcohol involved in single vehicle accidents, and it’s often a sign someone out there contributed to the victim’s death.

The questions is, have authorities found out where the alcohol came from? In Texas, it’s illegal for bars and other alcohol providers to over-serve alcohol to someone who is obviously intoxicated. If they do so, and that person gets hurt or killed, the business opens itself up to all kinds of potential consequences, including civil liability, criminal charges, and fines and other penalties through the Texas Alcoholic Beverage Commission.

Maybe nothing like that happened here, but a man lost his life in this crash. Shouldn’t that warrant ensuring his loved ones are getting the whole story?
