Kamie Burrows Car Accident on Peavy Road in Dallas, TX

It appears from initial statements that a 31-year-old Garland woman was in a Mercury Grand Marquis going northbound on Peavy. From oncoming lanes, details say a southbound Chevy Cruze went left of center, resulting in the vehicles colliding. The Garland woman reportedly had serious injuries after the crash while the Chevy driver’s injuries were described as moderate.

Commentary by Attorney Michael Grossman

Most recent statements show that authorities believe the Chevy driver was under the influence of alcohol, but it is unclear right now if they ever filed any charges for drunk driving. This is a bit odd, since authorities typically are quick to recommend charges at even the slightest hint alcohol led to a crash. The trouble is it can be challenging to differentiate between authorities being extra thorough and authorities not giving a crash the attention it deserves.

For example, something I talk about a lot on this blog is how little attention negligent alcohol providers get after drunk driving wrecks. If a bar or similar venue illegally over-serves someone, and people get hurt, they should be held accountable for their actions just as the drunk drivers are held accountable for theirs. But too often, our firm is working a civil case against a bar, and authorities are no where to be seen. They put all of their focus on the drunk driver, then just moved on.

Other times, though, I’ve seen authorities equally motivated to see the negligent alcohol providers held accountable as they are the drunk drivers. That takes more time and effort, so they sometimes withhold their accusations from public statements until they’ve got the full picture: how much alcohol the driver had in their system, where they got their alcohol, how much they were served, etc. Hopefully the relative lack of information here is a sign authorities are exercising that sort of caution rather than overlooking something important.
