Commentary by Attorney Michael Grossman
While nothing is confirmed right now, authorities mentioned investigating alcohol as a possible factor in the crash. That could just be standard procedure for them to rule that factor out, but it could be there will be evidence confirming it. If that is what happened here, it could make things a lot more complex than folks may realize.
This is due to the fact that alcohol-related accidents in Texas rarely involve just one party. It’s often found that whoever was driving drunk was illegally over-served by a bar or some other negligent alcohol provider. Those providers can face criminal investigations, fines, license suspensions, and even liability if the drunk driver they over-served gets themselves or someone else hurt. Again, that may not be what happened here, but a serious crash calls for serious investigations. Given my experience with hundreds of cases against negligent alcohol providers, I’d hesitate to trust that authorities are considering that possibility on their own.
