Commentary by Attorney Michael Grossman
When it comes to single-vehicle accidents, there are many times where people involved find themselves unsatisfied with the answers they get from authorities. Sometimes, they feel investigations were incomplete, or they feel authorities just wanted to blame someone without considering the evidence. That’s why it can be important to follow up with authorities on their efforts.
Did investigators take the time and use the right tools to fully examine the crash? A vehicle leaving the road could be caused by road hazards, poor lighting, or even an evasive maneuver. Did authorities document skid marks, debris, and environmental factors to determine what happened? If the investigation was rushed, key details could have been missed.
Did they check for possible vehicle defects? Brake malfunctions, steering failures, or tire blowouts can cause a driver to lose control. Additionally, issues with seatbelts or airbags could make injuries worse than they should have been. Was the vehicle thoroughly inspected before evidence was lost?
Did they secure all electronic evidence? The vehicle’s Engine Control Module (ECM) may have recorded key data such as speed, braking, and steering inputs before the crash. GPS records, cellphone data, or nearby surveillance footage could also provide valuable insights. Were investigators careful to preserve this information?
If authorities can prove that they have clear answers, it’s likely a sign they were thorough in their investigations. Otherwise, if things still aren’t adding up, it may be time for there to be more thorough investigations to clear things up.
