Commentary by Attorney Michael Grossman

It’s unfortunate to see yet another life taken due to drunk driving here in DFW. Every time it happens, there’s rightfully an outcry from the public that something needs to be done to help prevent further accidents. To that end, authorities should make more of an effort to include negligent alcohol providers in their investigations.

Not many people know about this, but alcohol providers play a role in accidents like this one all the time. When they illegally over-serve someone who is already obviously intoxicated, they’re contributing to the risk of this kind of accident happening. That’s why those providers can face criminal investigations, fines, license suspensions, and even liability for resulting injuries or death. By providing avenues through which those negligent alcohol providers can be held accountable, victims and families get to see accountability for the wrongs done to them, and those providers are forced to clean up their act before more people get hurt.

That’s why I bring up this area of the law. I’ve handled hundreds of cases against negligent alcohol providers. I’ve seen how once they’re actually held accountable, they start to behave, knowing that being reckless exposes them to serious consequences. Too often, though, those consequences only come through legal avenues which authorities aren’t likely to pursue on their own.
