Commentary by Attorney Michael Grossman
Generally speaking, when people fail to control their speed, it’s because they were on their phone. That’s one of the first things we look into following any serious crash—pull the phone records and look at what was going on at the time of the collision. Maybe that isn’t what happened here, but it absolutely needs to be part of the investigations.
The reason I bring this up is because it would shock people how often authorities didn’t do that. At the end of the day, drivers are not compelled to hand over their phone data without a court order. Not all departments are willing to jump through those hoops for a traffic accident, so they may just issue whatever citations they can and move on. That’s simply not good enough.
Perhaps authorities have been more thorough behind the scenes to determine exactly what happened here, who’s responsible, and what avenues are best for seeing there’s accountability. However, that’s not something I’d ever take for granted. That’s why anytime victims and families feel they’re not really getting clear answers about what led to the crash, it can be prudent to find out if authorities are really asking the right questions.
