Commentary by Attorney Michael Grossman

Accidents involving emergency responders and roadside workers underscore the critical need for careful investigation into how and why such incidents occur. Based on my experience handling cases like this, when an accident results in injuries and loss of life, there are three key questions that must guide the inquiry.

First, did authorities conduct a thorough investigation of the scene? Determining why a vehicle entered an active accident scene and caused further harm is a vital part of understanding the events that unfolded. Investigators should assess physical evidence like tire marks, vehicle positions, and potential distractions. Witness accounts from those present at the scene could also provide crucial context about the striking vehicle’s actions and behavior leading up to the crash.

Second, has anyone considered whether a mechanical issue or other external factors contributed to the wreck? While human error is often assumed in situations like this, it is important to rule out vehicle malfunctions that could have caused the driver to lose control. Similarly, the scene itself should be reviewed to ensure it was adequately marked and lit to warn approaching drivers of the danger ahead.

Finally, has all electronic data from the vehicles involved been collected? Event data recorders (EDRs) from the striking vehicle could shed light on factors such as speed, braking, and steering inputs before the crash. This information is invaluable for understanding whether the driver attempted to avoid the collision and, if so, why those efforts were unsuccessful.

Accidents at active emergency scenes demand meticulous investigation to uncover every contributing factor. By addressing these questions, investigators can provide a clear picture of what happened and why. For those injured and for the loved ones of the driver who lost their life, obtaining these answers is a vital step toward clarity and closure.
