Commentary by Attorney Michael Grossman
People may be too quick to read this and assume everything is open-and-shut. Authorities say a truck failed to yield, and a crash occurred. Shouldn’t that be the end of it? Well, it’s important to know why that happened. I’ve handled hundreds of commercial vehicle accident cases. The potential involvement of an employer means it’s important to understand the driver’s working conditions and whether or not that environment played a direct role in the crash.
For example, was the driver properly qualified? Were they hired despite a history of reckless driving? Were they rushing to meet unreasonable deadlines? Were they distracted by an employer who hounded them over the phone or radio? Is this a company vehicle that hasn’t been properly maintained, leading to a mechanical issue? Did the truck have headlights, tires, brakes, or other parts needing to be replaced? Did the truck have any cameras onboard they have yet to hand over to investigators?
These are the kinds of questions I generally see independent accident reconstructions answer. However, they’re not always the sorts of questions authorities ask. That means unless there’s another set of eyes looking things over here, important details may be overlooked. So while it’s possible authorities have taken steps to give this crash the attention it needs, it may instead be true that investigations have only scratched the surface so far. If those involved in a serious truck wreck are going to get a fair resolution, a prudent first step is to make sure they have all the facts at their disposal.
