Commentary by Attorney Michael Grossman

Pedestrian accidents sometimes cause confusion because people tend to only think of them in terms of who had the right-of-way. The law, however, is more nuanced. There has to be consideration for all kinds of potential contributing factors. Was the driver distracted? Is the area poorly lit? Were signals not working properly? Were other drivers able to avoid the pedestrian without issue? Was alcohol a factor? Likely or not, a victim’s loved ones deserve to know they’re getting the full story. That can’t happen if authorities end up making hasty assumptions without considering all the facts.
