According to officials, 54-year-old Josue Pedraza was doing plumbing and HVAC work at the time. In an unspecified situation, Josue Pedraza succumbed to fatal injuries.

How Did This Accident Occur?

The OSHA statements did not specify the exact nature of this accident. These investigations follow just about any workplace death, whether it was something avoidable like lack of safety equipment or unavoidable like a medical emergency. Of course, the allegations of rule violations and a recommended penalty point to the possibility there were safety issues on this job site which could have contributed to the victim’s death. What’s important going forward is making sure investigations look into those issues beyond just looking for specific rule violations.

Frankly, OSHA tends to have a very narrow scope in their priorities, and that can allow important information to slip through the cracks unless there are secondary investigations more focused on just getting the full story and providing answers to the victim’s family. This is especially important considering Texas has uniquely complex work fatality laws, and getting a worker’s family the resolution they deserve can require navigating a legal maze which OSHA rarely offers any guidance for. As such, it can take families pursuing their own solutions independent of OSHA’s efforts to actually achieve a fair and just resolution.
