Commentary by Attorney Michael Grossman

I get calls all the time from folks who feel like authorities aren’t really giving their situation the attention it deserved. Of the types of crashes I get calls about, single-vehicle wrecks and motorcycle accidents are among the worst offenders. This is because both carry a lot of preconceived biases, and authorities are more likely to just jump to conclusions without really giving the victim a chance to tell their side of the story.

While things like driver error are common, there are plenty of other possibilities a more prudent, independent investigator would at least seek to rule out. Mechanical issues, road hazards, tire blowouts, medical conditions, lack of signage or lighting, etc. So when folks find themselves still in the dark or feel like authorities were just looking for someone to blame, it’s only reasonable they’d look for other avenues to ensure the evidence could speak for itself and give a fair account of what actually happened. It remains to be seen if this is one of those situations or if authorities actually took the time to let the facts do the talking.
