Chicago, IL — April 16, 2025, Joshua Kutz was killed as the result of a semi-truck accident that happened along Illinois 394.
Authorities said that the crash happened at the intersection of Highway 394 and Burrville Road.

According to the Illinois State Police, 40-year-old Joshua D. Kutz was in a Chevy Malibu going southbound along the highway. A semi-truck was going eastbound on Burrville Road. Authorities allege that the truck failed to yield making a left turn, and the vehicles collided.
Joshua Kutz was killed due to the accident. The truck driver has reportedly been arrested on allegations of “Aggravated Driving Under the Influence of Drugs Involving Death.”

If the allegations here are true, that obviously calls for harsh consequences. But there could be more to this story that police have yet to touch on. A truck driver allegedly on drugs is bad enough, but there’s a serious questions about whether or not there was an employer who could have prevented all of this.
In my experience handling hundreds of commercial vehicle accident cases, truck drivers being on drugs is rarely some out of no-where thing. More often, there is a pattern of behavior that any reasonable company would be able to catch. It could be that they conduct regular testing to catch drivers using substances, or it could be they conduct rigorous background checks to weed out drivers with a history of driving under the influence.
If a company fails in this regard, they would need to answer for those oversights resulting in a deadly accident. Not only that, but bringing them to light would be a vital step in getting them to clean up their act before more people get hurt. That’s why I have to wonder if authorities have taken steps to look into this accident beyond just the driver’s alleged actions.
