Commentary by Attorney Michael Grossman

With a rear-end collision like this, it’s easy for folks to jump to conclusions and assume everything is open-and-shut. In reality, though, there can be a complex series of events leading to crashes like this, even if it involved something more common, like a distracted driver. Here’s what I mean by that.

One factor that authorities too often overlook is the role a driver’s employer can play in the crash. For example, employers often pressure drivers to meet unrealistic delivery schedules, which can lead to speeding, driving while distracted, skipping rest breaks, and otherwise cutting corners for the sake of time. They might also fail to ensure proper vehicle maintenance, leaving drivers to operate trucks with faulty brakes, worn tires, or other mechanical issues. Additionally, some companies cut corners during the hiring process, allowing inexperienced drivers or drivers with a history of reckless behavior behind the wheel.

When a company engages in this kind of behavior, they set the stage for a serious crash to happen. Allowing those companies to continue that sort of behavior is bound to lead to future accidents, which is just another reason to make sure investigations into crashes like this are as thorough as possible. In my experience, folks don’t want some bad guy to blame. They want to see accountability. Most everyone would agree that doesn’t involve letting someone off the hook simply because authorities never bothered looking in their direction.
