Right now, authorities allege that the southbound driver was intoxicated at the time, and they filed a charge for intoxication manslaughter. Despite what some may think, a details like that does not necessarily make this situation open-and-shut. Intoxicated driving accidents can vary quite a bit depending on whether or not alcohol was the intoxicant. This is because alcohol providers may also have consequences to face for contributing to the accident.
Simply put, it’s illegal in Texas for bars and other alcohol providers to over-serve someone who is obviously intoxicated. Doing so exposes providers to potential criminal investigations, fines, license suspension, and liability for resulting injuries. But too often, authorities simply blame the intoxicated driver and move on without getting the whole story. This can leave victims and families in the dark unless they pursue those avenues independent of police efforts. Maybe authorities have been more thorough here, but that’s not something to take for granted.
