Commentary by Attorney Michael Grossman

When crashes like this occur, it’s common for people to focus on the immediate collision and assume it was caused by a simple mistake or misjudgment. However, based on my extensive experience handling commercial vehicle accident cases, incidents involving 18-wheelers are rarely that straightforward. They often require a deeper investigation into multiple factors that may have contributed to the outcome.

In this case, reports suggest that a Kenworth 18-wheeler may have been traveling at unsafe speeds before the collision. If true, that raises serious questions about why the truck driver was unable to control their vehicle effectively. Was the driver fatigued, distracted, or otherwise impaired? Was the truck experiencing mechanical issues that made it difficult to stay in its lane or maintain proper control? Each of these possibilities needs to be thoroughly investigated to uncover the root cause of the collision.

It’s equally important to examine the role of the trucking company responsible for the 18-wheeler. Companies are required to ensure their vehicles are properly maintained and their drivers are trained to operate safely. Was the truck in compliance with all safety regulations, and was the driver adhering to hours-of-service requirements to avoid fatigue? If the company pressured its driver to meet unreasonable deadlines or failed to enforce critical safety measures, it could bear some responsibility for what occurred.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
