Commentary by Attorney Michael Grossman
When a crash involves two commercial vehicles and results in a fatality and multiple injuries, as in this case, the questions that come to my mind often center on responsibility, contributing factors and whether the crash could have been avoided. At this stage, with limited information, several aspects warrant close investigation.
Right-of-Way and Turning Movements: One vehicle was reportedly waiting to turn onto a private ranch road. Did this vehicle have the right-of-way, and were its movements communicated properly to other drivers? Was the turning vehicle properly using its signals, and were they visible to oncoming traffic? Improper signaling or misjudging the speed of approaching vehicles is a frequent cause of collisions.
Speed and Visibility: The crash occurred at 5:30 a.m., a time when visibility can be limited due to low light. Speed is another key consideration. Were lighting conditions or poor visibility factors in the crash? Were the vehicles traveling at appropriate speeds for the conditions? The vehicles’ engine control modules could reveal whether excessive speed or abrupt braking contributed to the collision.
Driver Behavior: Distracted driving, fatigue, or impairment are common causes of crashes involving commercial vehicles. Investigating both drivers’ conditions, including their Hours of Service (HOS) compliance and cellphone activity, will be crucial.
Passenger Safety: With six people inside the two vehicles, questions arise about passenger safety measures. Were the passengers wearing seatbelts? Did overcrowding contribute to the severity of injuries or fatalities?
Vehicle and Roadway Conditions: The condition of the vehicles must be analyzed. Were there mechanical failures, such as brake or steering issues? Maintenance records for the commercial vehicles will be critical. Highway 83 is a well-traveled route in rural Texas. Was the road in good condition, with clear signage and sufficient space for turning vehicles?
The official investigation should be able to establish a clear understanding of what happened by analyzing evidence at the crash scene and gathering witness statements, bolstered by data from the vehicles about speed, braking and other driver inputs leading up to the crash. Cell phone data could shed additional light on the moments before the crash.
At this stage, the investigation must go beyond surface-level factors to consider a wide range of potential contributing issues. Independent analyses, including vehicle inspections and witness interviews, could be vital to uncovering the causes of this crash. Understanding who was responsible and why is crucial not just for accountability but also for helping the affected families gain clarity.
