Schertz, TX — May 28, 2024, Jose Gonzalez Fuentez was killed following a workplace accident at around 11:22 a.m. off Tejas Way.

Authorities said in preliminary statements that the incident took place on a site off the intersection of Doerr Lane and Tejas Way, north of I-35.

OSHA released a preliminary investigation summary. Authorities said only that Jose Gonzalez Fuentez on a site reportedly associated with Yantis Construction Company. While working near an excavator lifting a box, a chain failed, causing Jose Gonzalez Fuentez to be pinned between the equipment and a wall. As a result, Jose Gonzalez Fuentez was fatally injured.

It’s unclear if anyone else was hurt in the accident. Investigations from OSHA appear to be ongoing.

It’s not surprising to anyone that OSHA is getting involved here, but people don’t often understand what exactly that can mean for a victim’s loved ones. I get calls from folks all the time after they got reports from OSHA only to find they still had all kinds of unanswered questions. The reality is OSHA has their own priorities, and they don’t necessarily align with those of a family who need answers and help.

That’s especially true considering Texas has the most complex work fatality laws of any other state in the country. Navigating that law requires more than just an preliminary investigations whose focus is looking for safety violations to issue fines for. If there aren’t investigations from experienced professionals whose priority is to get the whole story for the victim’s loved ones, there’s just no telling what could slip through the cracks.
