Commentary by Attorney Michael Grossman

Following work accidents like this, people tend to assume that OSHA takes care of everything. However, families often find the actions of officials lacking. This is because authorities like OSHA have their own priorities. Those may align somewhat with the needs of a worker’s family, but rarely does it cover the whole process. Texas has the most complex work fatality laws in the country, and that takes extensive evidence and legal maneuvering to properly navigate.

So when OSHA’s efforts help families navigate that path, that’s good. It’s just not the norm. What normally has to happen is a thorough independent investigation that covers all angles and ensures the family has the whole story—not just the bare minimum needed for some administrative penalties.
