Commentary by Attorney Michael Grossman

One of the primary concerns with motorcycle accidents is that there are a lot of people out there who assume the worst of riders. I know from my experience working with families over the years that most motorcyclists are safe drivers. Others, however, jump to conclusions and rush to blame them before they even have any of the facts. Unfortunately, even authorities can make this mistake.

This is just another reason why it’s important for people to follow up with the authorities if they have concerns or questions. Have authorities looked into road conditions? Lighting? Have they looked for nearby security cameras at residences or businesses? Did they pull cell phone data, which could provide GPS information of the moments prior to the crash? Did they have the time and tools to properly reconstruct physical evidence at the accident scene?

If authorities are able to address a family’s concerns, it’s probably because they did good, thorough investigations. But if families ever feel their concerns aren’t being adequately addressed, then that may be a sign the crash needs another set of eyes looking things over. It can be a crucial step forward for a family to feel assured that unfair bias or haphazard investigations aren’t standing between them and the truth.
