Commentary by Attorney Michael Grossman
Regardless of what exactly happened here, the possible involvement of alcohol can make things rather complex. As much as people assume drunk driving accidents are open-and-shut, they raise an important questions that too often goes overlooked: Where did the alcohol come from? Here’s why that matters.
Under Texas law, those alcohol providers have a legal duty not to serve anyone who’s obviously intoxicated. In my experience, drivers who are intoxicated at the time of a crash usually were drinking somewhere beforehand. If investigations show that an establishment over-served someone, and it led to a crash, the alcohol provider can be held responsible for their role in the accident.
This isn’t about shifting blame—it’s about ensuring every part of the chain of events is examined so that those who contributed to the harm can be held accountable. This is important not only to those directly affected by a drunk driving crash, but also to the broader public. So if that’s not something authorities have looked into yet, there could still be more to the story.
