Commentary by Attorney Michael Grossman
While this may seem like a pretty-straight forward crash, any accident can present unique challenges. Families deserve to know that they’re going to get answers, which is why it is important to know those challenges are being properly addressed. Simply assuming that authorities are up to the task doesn’t always yield satisfactory results.
Investigations need to look beyond driver behavior alone. For example, did the RV have any problems with its braking or steering systems? Were its headlights working properly? Had it been properly maintained for highway travel? In order to answer these questions, it is always prudent to preserve the vehicles involved in a serious accident. Did authorities do that here?
Additionally, collecting electronic data can help shed light on the crash as well. Most vehicles have engine control modules that can reveal speed, braking inputs and steering activity. Investigators also should track down footage from dashcams, traffic cameras or nearby homes or businesses that may have captured the collision on video. The victim’s cell phone also may provide valuable data on events leading up to the accident.
These kinds of details don’t encompass the entirety of what a thorough accident reconstruction should cover. However, I’ve been doing this for 30 years, and these are the kinds of details I see authorities overlook all the time.
