Commentary by Attorney Michael Grossman
When people hear about crashes like this one, it’s easy for them to assume they are a result of simple driver error. However, in my experience, accidents involving large trucks often require thorough investigations to understand all contributing factors.
In this case, it is essential to determine why the 18-wheeler entered the intersection at an unsafe time, failing to yield the right of way. Potential factors like mechanical failure, driver distraction, or even inadequate training should be considered. Each of these elements can significantly affect a driver’s ability to make safe decisions on the road.
The severity of the collision, which resulted in the 18-wheeler overturning, highlights the risks associated with large truck accidents. Investigators must scrutinize whether the truck driver adhered to traffic regulations and if there were any issues with the vehicle’s maintenance. Regular inspections and proper upkeep are vital for ensuring that commercial trucks operate safely on highways. Any lapses in this area could indicate negligence on the part of the trucking company or the driver.
Moreover, the trucking company responsible for the 18-wheeler may share in the responsibility for the accident. If the company failed to enforce safety protocols, properly train their drivers, or ensure that their vehicles were in good working order, they could be held accountable for their role in the crash.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
