Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured driver is receiving proper care and that investigators are examining all aspects of the incident to determine what caused it. A single-vehicle crash resulting in a rollover after leaving the road is not an uncommon event, but in my experience, it’s rarely explained by driver behavior alone. To understand what happened on County Road 1900, we need to ask three critical questions.
First, did the authorities thoroughly investigate the crash? A vehicle veering off a rural road at 2:40 a.m. raises immediate questions about visibility, road conditions and possible environmental hazards. Was the road properly lit or marked? Were there sharp curves, debris or drop-offs that could have contributed to a loss of control? Did the vehicle attempt to avoid something in the roadway? Investigators should document the scene carefully to assess whether the roadway itself, or conditions at the time, played a role in the incident.
Second, has anyone considered whether a vehicle defect may have contributed to the crash or its severity? The 2018 Nissan Maxima involved should be inspected for possible issues with the steering, brakes, suspension or tires, any of which could cause a sudden loss of control, especially at highway or rural road speeds. In addition, because the crash resulted in a rollover, it’s critical to determine whether the vehicle’s safety systems — like airbags, seatbelts and roof structure — performed as they should have. These questions can only be answered through a forensic inspection of the vehicle.
Finally, has all the electronic data related to the crash been collected? The Maxima likely has an engine control module that stores pre-crash data such as speed, throttle input, braking and steering activity. This information can help confirm whether the driver attempted to correct course or whether the vehicle’s behavior changed unexpectedly. Additionally, GPS data, phone usage records or nearby surveillance footage may offer a more complete timeline and location reference. Preserving this evidence early in the investigation is critical to ensuring its accuracy.
Crashes like this deserve careful, methodical investigation. A man suffered serious injuries, and while it may appear on the surface to be a simple case of losing control, the underlying causes may involve factors beyond the driver’s actions. Only by asking the right questions and preserving all relevant evidence can we ensure a complete understanding of the incident, and provide the injured party and their family with the clarity and accountability they’re entitled to.
